Resort, LLC.
1. ELIGIBILITY: The Men’s Wearhouse, Inc. Winning Suit
Sweepstakes (“Sweepstakes”) is open to legal residents of one of the United
States or District of Columbia (“United States”), except for residents of
Oklahoma or other U.S. Territories, who are eligible to play the online poker
component, but are not eligible to win any prize. Entrants must be 21 years of age or older as
of May 1, 2012. Employees of Phenomenon, Inc., The Men’s Wearhouse, Inc., Venetian
Casino Resort, LLC , Las Vegas Sands
Corp., and their respective parent, subsidiary and affiliate companies as well
as the immediate family (spouse, parents, siblings and children) and household
members of each such employee are not eligible. Void where prohibited.
2. TIMING: The Sweepstakes begins on May 1, 2012 at 12:01 a.m.
Pacific Time ("PT") and ends on June 30, 2012 at 11:59 p.m. PT (the
"Promotion Period"). Sweepstakes Administrator’s computer is the
official time keeping device for the Sweepstakes.
3. HOW TO ENTER: No purchase is necessary to enter Sweepstakes.
Primary
Entry Method: To enter, visit the “The Winning Suit” microsite at
menswearhouse.com/vegas. Play “The Winning Suit” poker game by entering a
number of virtual chips to ante. You will receive two cards, face up. There will be three community cards, which
are also part of your hand and are dealt face down. If you choose to fold,
click “Fold”. If you decide to play,
enter the number of chips to wage in “3rd Street” by selecting to
raise 1x, 2x, or 3x the amount of the original ante. The dealer will then turn over one of the
community cards. If you choose to continue to play, repeat the wager process
for 4th Street and 5th Street. Otherwise select “Fold”.
If you achieve a hand of a pair of Jacks or better, you will reveal a link to
the sweepstakes registration page where you can register for the
sweepstakes. The second time you achieve
Jacks or better, you may reveal links to discount offers on The Men’s Wearhouse
products. There is approximately a 1 in 3 chance of achieving a Jacks or better
with any single hand. To automatically qualify for the registration, simply
play the game 10 times to activate the registration link, regardless of whether
you achieve a winning hand. There is
also a link on the microsite allowing you to directly access the registration
page without playing the poker game. On the registration page, completely
provide and submit the information requested.
Or,
enter through Facebook by either visiting the Men’s Wearhouse Facebook page
at www.facebook.com/menswearhouse and follow the link to
the registration Facebook App or directly through the registration Facebook App
on Facebook. When registering via the Facebook App, you must first select the
“Like” button before being granted access to the registration page. (note:
Liking Men’s Wearhouse directly via Facebook will not result in an
entry). This promotion is in no way sponsored, endorsed or
administered by, or associated with, Facebook.
Additional Referral
Entries: Entrants may also receive one additional daily entry for
each time the Entrant refers a friend through a refer-a-friend link available
on the either the microsite or Facebook App registration page and the referred
friend either (1) enters the sweepstakes by clicking through the refer-a-friend
email associated with the respective Entrant and supplies a unique email
address, or (2) responds to a referral request received from Men’s Wearhouse
Promotion Facebook App. Each refer-a-friend email or App request will be
associated with the Entrant who made the referral. Each Entrant may refer up to five (5) friends
per day regardless of referral method. Entrant will receive the additional
entry when a referred friend successfully enters the sweepstakes through the
refer-a-friend email or Facebook App request, during the Promotion Period. The referred friend will receive an email
inviting them to register for the sweepstakes, but will not be opted in to receive
other Men’s Wearhouse marketing communications unless the referred friend
either enters the sweepstakes or otherwise opts in to receive such messages.
Entries may be subject to verification prior to prize drawing. All entries become the property of the Sweepstakes Administrator and will not be acknowledged other than through the entry process. Limit one Primary Entry per person per day, regardless of entry method.
4. ODDS: The estimated odds of winning will depend upon the
total number of eligible entries received.
5. PRIZE: One (1) Grand Prize winner will receive
the following prize package:

Round trip coach airfare for four (4) from any
major airport within the continental U.S. to Las Vegas, NV. (Approx. Retail
Value (“ARV”) is $2,000).
·
Vouchers for two (2) Prestige Level Luxury Suite
rooms at the Palazzo, Las Vegas, in Las Vegas for two (2) consecutive nights.
(ARV - $1,400).
·
Vouchers for two dinners for (4) people ($400
per dinner, $800 total)
·
Entertainment Package: one pool side cabana; nightclub
admission for four; Grazie Level Player Status (ARV - $1,500)
·
Airport Transfer (ARV -$150).
·
Four (4) Men’s Wearhouse suits (ARV - $350 each,
total $1,400).
Total Grand Prize ARV $7,250. If winner chooses not to take a guest or guests, or chooses not to accept certain prize elements due to age restriction or any other reason, then that guest(s) element will be forfeited and the remaining elements shall constitute full satisfaction of the prize. Some restrictions may apply. All travel and hotel portions must be completed by March 31, 2013. The four (4) Men’s Wearhouse suits are provided by The Men’s Wearhouse. All other prizes are provided by The Venetian Casino Resort, LLC.
6. PRIZE RESTRICTIONS/CONDITIONS: Prizes are non-transferable. No substitution or cash equivalent of prize permitted except at Sweepstakes Administrator’s discretion. Sweepstakes Administrator may substitute any prize element for a comparable alternate prize element of equal or greater value. The value of some prize elements may vary depending on factors such as the departure airport or date and time of travel. If actual value of any prize element (e.g., such as airfare) is less than the ARV, Prize Winner will not receive the difference between the actual value and the ARV. Trip dates and some prize elements may be subject to availability and blackout dates. In Sweepstakes Administrator’s sole discretion, Sweepstakes Administrator may permit Prize Winner to make travel arrangements that differ from the prize description above, in which case, Prize Winner will be responsible for any costs incurred that exceed the ARV for any particular element of the Prize. Prize Winner and his/her guests must travel on the same itinerary and are responsible for obtaining any/all necessary documents (including but not limited to valid photo I.D.) prior to departure. If any guest is a minor, then that guest’s parent or legal guardian must be the Grand Prize Winner or one of the other accompanying guests. The round trip flights for the travel element must originate and end at the same airport, which must be a regional airport or larger that offers regular commercial passenger flights.
7. DRAWING: A Potential Prize Winner will be selected via a random drawing conducted on or about July 9, 2012.
8. NOTIFICATION OF WINNER/AWARDING OF PRIZE: The Potential Prize Winner will be notified on approximately July 10, 2012, and will have 72 hours from the time of the notification attempt to respond. Upon receipt of the Potential Prize Winner’s response, The Potential Prize Winner will be sent an Affidavit of Eligibility, a Liability Release and where legal, a Publicity Consent Release (“Verification Package”), which the Potential Prize Winner may be required to complete, sign, have notarized and return within five (5) business days of date of issuance. Guests may also be required to complete a Liability Release, and where legal, a W9, a Publicity Consent Release, prior to travel. If not timely returned or if prize notification or e-mail is returned as undeliverable, prize may be forfeited. If winner is not 21 years of age of majority in state of residence as of May 1, 2012, or otherwise does not meet the eligibility criteria defined above, the prize may be forfeited. In the event that the Potential Prize winner cannot be notified or is unable, for whatever reason, to return the Verification Package within the required time, Sweepstakes Administrator may select an alternate prize winner from among all remaining eligible entries. If a Prize Winner cannot be verified after Sweepstakes Administrator has selected three potential alternate prize winners, then the prize may remain unawarded, at Sweepstakes Administrator’s sole discretion.
9. ADDITIONAL TERMS: Winners are responsible for any and all
federal, state, and local taxes, as well as any other costs and expenses
associated with acceptance and use of prize not specified as covered as
part of the prize herein, including, without limitation, additional ground
transportation, hotel upgrades, meals, luggage fees, gratuities, souvenirs and
insurance for Grand Prize. By participating in this Sweepstakes, entrants
agree to (a) abide by the Official Rules and the decisions of the Sweepstakes
Administrator], which shall be final, and (b) release, discharge and hold
harmless Sweepstakes Administrator, the Prize Providers, Facebook, and their affiliates,
subsidiaries and promotion and advertising agencies including, their parent,
affiliates, subsidiaries and related companies, and the respective employees,
directors and officers of the foregoing (collectively "Releases"),
from and against any/all claims, losses, injuries or damages, including death,
resulting from the acceptance, use or misuse of any prize and/or participation
in the Sweepstakes.
By accepting the prize, winner agrees and consents, where legal, to the use of
his/her name and/or likeness without further authorization, compensation or
remuneration of any kind for advertising, promotions, and other publicity
purposes in all media and on the Internet. Sweepstakes Administrator reserve
the rights, in its sole discretion, to disqualify any individual found to be
tampering with the entry process or the operation of the Sweepstakes or
Website; to be acting in violation of the Official Rules; or to be acting in an
unsportsmanlike or disruptive manner, or with intent to annoy abuse, threaten
or harass any other person. Any use of robotic, automatic, programmed or
similar entry methods will void all such entries submitted by such methods. In
the event of a dispute as to entries submitted by multiple users having the
same e-mail account, the authorized subscriber of the e-mail account used to
enter the Sweepstakes at the actual time of entry will be deemed to be the
participant and must comply with these Official Rules.
The authorized account subscriber is deemed to be the natural person who is
assigned an e-mail address by an Internet access provider, online service
provider or other organization responsible for assigning e-mail addresses or
the domains associated with the submitted e-mail addresses.
CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY
DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY
BE A VIOLATION OF CRIMINAL AND CIVIL LAW AND, SHOULD AN ATTEMPT BE MADE, SWEEPSTAKES
ADMINISTRATORS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE
FULLEST EXTENT PERMITTED BY LAW.
10. LIMITATIONS OF LIABILITY: Sweepstakes Administrator is not
responsible for any late, lost, illegible, incomplete or misdirected entries,
or responsible for incorrect or inaccurate information, whether caused by Web
site users or by any of the equipment or programming associated with or
utilized in the Sweepstakes; any error, omission, interruption, deletion,
defect, delay in operation or transmission, communications line failure, theft
or destruction or unauthorized access of the Web site; any injury or damage to
participants or to any other person's computer(s) related to or resulting from
participating in this Sweepstakes, or downloading materials from or use of the
Web site. If, for any reason the Sweepstakes cannot be conducted as planned by
reason of infection by computer virus, bugs, tampering, unauthorized
intervention, fraud, technical failures, or any other causes beyond the control
of the Releases which, in the sole opinion of the Sweepstakes Administrator,
corrupt or affect the administration, security, fairness, integrity or proper
conduct of this Sweepstakes, the Sweepstakes Administrator reserves the right,
in their sole discretion, to cancel, terminate, modify or suspend this
Sweepstakes or the drawing and may conduct drawing and select a winner from among
all eligible entries received for the drawing prior to the action taken. In no
event will the Sweepstakes Administrator and/or Prize Providers and Releases be
responsible or liable for any damages or losses of any kind, including direct,
indirect, incidental, consequential or punitive damages arising out of access
to and use of the Sweepstakes web site or the downloading from and/or printing
material downloaded from said site.
Without limiting the foregoing, everything on the site is provided "as
is" without warranty of any kind, either expressed or implied, including
but not limited to the implied warranties of merchantability, fitness for a
particular purpose or non-infringement. Some jurisdictions may not allow
limitations or the exclusions of liability for incidental or consequential
damages, or exclusion of implied warranties, so some of the aforementioned
limitations or exclusions may not apply.
